All payments including the retainer and makeup preview fees are final, meaning non-refundable and non-transferrable. The final balance is due up to 2 weeks prior to the event date as one payment. The person responsible for the entire balance of payment is the person who has signed the booking contract.

Additional unplanned and/or un-contracted services (such as addition to headcount, touch-up stay) are considered overtime and will be billed with prior notification and consent at the rate of $200 per hour for overtime stay and $200 per additional persons.

1 reserved priority parking space per artist is required at the location where makeup services will be performed. Valet parking is required for makeup services taking place at hotel. All valet, parking fees, and tolls are covered separately by the bride.

Depending on the start time and complexity of services needed, the bride is required to book a hotel accommodation (1 room, 1 bed per artist, for the night prior to the event) within 15 miles of site in a safe location for all employees of Samantha Keefauver working the event. Client is responsible to book the hotel room at least 60 days prior to the event.

Your booking is a reserved spot. If your event is canceled, no portion of the fees paid to Samantha Keefauver will be returned. Under the foreseen or unforeseen event that the Client must cancel, Samantha Keefauver must be notified of event cancellation at least 90 days prior to the service date or Client will be responsible for 100% of the remaining balance agreed upon in this contract. Changes to the terms of this contract will be at the discretion of Samantha Keefauver. In the unforeseen event that Samantha Keefauver becomes ill or is unable to perform services on the reserved event date, she will refund the retainer fee to the signed holder of this contract.

In the foreseen or unforeseen circumstance that this contract’s agreed event date must change and Samantha Keefauver agrees to the new date, a new contract and a new retainer fee are required to secure the new date. Samantha Keefauver will void the original contract, and all previous payments and the retainer fee for the original event date remain non-refundable & non-transferrable.

Once the contract is signed by both parties, no services outlined within the contract can be revoked, removed, or altered. All services agreed in this contract are deemed final and binding upon signing.

Any requests for additional services after this contract is signed must be submitted in writing at least 30 days prior to your service date. Additions requested on the day of service are at the discretion of Samantha Keefauver and are not guaranteed. Any agreed additional performed services to this contract will be paid in full upon completion and are billed at regular posted rates. No refund is given for members who miss or refuse their appointment for any reason.

Samantha Keefauver will use reasonable efforts to ensure Client's desired Services are produced in a style and manner consistent with Samantha Keefauver's current portfolio and Samantha will try to incorporate any reasonable suggestion made by Client. However, Client understands and agrees that:

Every client is different, with different tastes, budgets, and needs;

Samantha Keefauver's services are often a subjective art and she has a unique vision, with an ever-evolving style and technique;

Samantha Keefauver will use her artistic judgment when providing Services for Client, which may not include strict adherence to Client’s suggestions;

Although Samantha Keefauver will use reasonable efforts to incorporate Client’s suggestions and desires when providing Client with the Services, Samantha Keefauver shall have final say regarding the aesthetic judgment and artistic quality of the Services;

Dissatisfaction with Samantha Keefauver's aesthetic judgment or artistic ability are not valid reasons for termination of this Agreement or request of any monies returned.

Makeup will be completed to client’s satisfaction, but is not to exceed allotted makeup time. Ample time is given for each makeup application upon booking at 1 hour for the bride and 45 min per additional person. Acceptance of completed makeup application by client is acknowledgement by client that makeup is done to his/her satisfaction.

The responsibility of the makeup artist(s), Samantha Keefauver or her assistant(s), is limited. Samantha Keefauver or her assistant(s) shall not be liable for any loss, injury, illness, or damage to any client and/or property. You agree that Samantha Keefauver or her assistant(s) will not be held liable for any damages to any client and property in connection with terrorist activities, social or labor unrest, mechanical, or construction failures or difficulties, illness, local laws, weather, strikes, thefts, pilferage, or defaults, Samantha Keefauver is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the Vendor, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance.

It is understood & agreed that Samantha Keefauver or her assistant(s) will not be liable to the customer or any agent associate of the customer, for any mistake or error in judgment or for any act of omission done in good faith and believed to be within the scope of authority conferred or implied by this agreement. Client agrees to not hold Samantha Keefauver or her assistant(s) liable for property damages or event day complications that could result in monetary loss.

Any skin condition shall be reported by the client to the makeup artist prior to application and, if need be, a sample test of makeup may be performed on the skin to test reaction. Client(s) agree to release Samantha Keefauver or her assistant(s) from liability for any skin complications due to allergic reactions. Samantha Keefauver or her assistant(s) reserve the right to refuse services or alter services if unsanitary conditions exist and/or contagious infections are present. Client understands and acknowledges that Samantha Keefauver or her assistant(s) may alter service(s) or NOT perform services where any contagious infections or illness such as pink eye (conjunctivitis) or cold sores/fever blisters are present and there shall be no refund of any paid retainer fee and Client will pay the remaining balance in full. Client also acknowledges that they will allow Samantha Keefauver and her assistant(s) to work in safe conditions for personal safety. At any time, Samantha Keefauver or her assistant(s) feels physically threatened or verbally abused, they may cease the performance of services and exit the location of services.

It is understood that Samantha Keefauver is only liable for services completed and provided by Samantha Keefauver and her assistants, and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Samantha Keefauver or her assistants be liable for consequential damages of any kind.

The Client(s) expressly agree(s) to take best efforts to provide Vendor and Vendor’s staff with safe and appropriate working conditions. In the event of circumstances deemed by either Vendor or a bystander to present a threat or implied threat of injury or harm to Vendor staff or equipment, the Vendor reserves the right to cancel all services remaining under this Agreement and leave the event. At the Vendor’s discretion, the Vendor may enact a three-strike policy. After the first offense, the Vendor will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), Vendor shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, the Vendor will immediately leave the event. If the Vendor leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold Vendor harmless as a result of incomplete event coverage, or for a lapse in the quality of the Vendor’s work, and the Client(s) shall be responsible for payment in full.

If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in additional to any other remedies to which that party might be legally entitled.

Notwithstanding the above, either party may choose to be excused of any further performance obligations in the event of a disastrous occurrence outside the control of either party, such as, but not limited to:

A natural disaster (fires, explosions, earthquakes, hurricane, flooding, storms or infestation); or

War, Invasion, Act of Foreign Enemies, Embargo, or other Hostility (whether declared or not); or

Any hazardous situation created outside the control of either party such as a riot, disorder, nuclear leak or explosion, or act or threat of terrorism.

Client and all parties obtaining services from Samantha Keefauver or her assistant(s) agree that they will not, directly or indirectly, make or ratify any defamatory comments, reviews or remarks as defined by law, in writing, orally or electronically, about Samantha Keefauver or her assistant(s) and their respective products and services. By receiving services, you agree to this contract stipulation whether or not this contract is signed by the party obtaining the service. Client acknowledges and agrees that verbal abuse is unacceptable by any person at the event and shall be grounds for Samantha Keefauver or her assistant(s) to cease services immediately. Client acknowledges that they will not be entitled to a refund for any work already performed and client may not review Samantha Keefauver or her assistant(s) poorly on social media or other review sites if such instance occurs.

Client authorizes Samantha Keefauver to use photos or videos of Client and members of their party for her future clients to view. Posting is on Samantha Keefauver's website, advertisements, and her social media platforms. (Samantha Keefauver will always ask for photographer’s permission before posting their professional photos and will post proper credit of their work)
